An uncontested or no-fault divorce in Virginia can be granted on the grounds of living separate and apart, continuously and without interruption for the statutory period. The parties must have lived separate and apart without cohabitation or interruption for a period of at least 12 months. If there are no minor children born of or adopted of the marriage and the parties have a signed property settlement agreement, a no-fault divorce can be obtained after a separation of 6 months. We perform no-fault divorces for a flat-fee if the parties are in agreement.
